Jazem platform is committed to providing comprehensive and secure digital solutions for debt collection operations management, contributing to cost reduction and operational efficiency improvement, while ensuring full compliance with transparency standards and adherence to regulations in force in the Kingdom of Saudi Arabia.

The client acknowledges that they have reviewed these Terms and Conditions and Privacy Policy and fully understood them before using the services of "Jazem Debt Collection Platform". Their use of the platform or any of its services constitutes explicit and binding acceptance of all terms, conditions, and policies contained therein, and this approval is legally effective in accordance with the regulations in force in the Kingdom of Saudi Arabia.

Jazem reserves the full right to modify or update the Terms and Conditions and Privacy Policy at any time without prior notice. Such amendments become effective upon publication on the electronic platform or via the Jazem application. The client's continued use of the platform after publication of amendments constitutes explicit agreement and commitment to such amendments.

Therefore, it is advised to review the Terms and Conditions and Privacy Policy periodically to monitor any changes.

1. General Information About Jazem and Contact Details

We are Jazem for Payments and Technical Solutions ("Jazem"), an established and organized company.

2. How to Contact Us

You can contact us directly through in-app support by selecting "Need Help?" from the menu.

How We Contact You:
If we wish to contact you, we will do so by calling you either by phone, email, or through the postal address registered in our application or electronic platform database.

3. Jazem Application and Electronic Portal

If you are a client, you must register via the Jazem application or through the electronic portal. Upon successful registration, a secret verification code will be sent to your registered phone number. Your use of this code constitutes confirmation of your full agreement to the Terms and Conditions.

All users of the Jazem application and electronic portal are subject to these Terms and Conditions. Your use of any platform service constitutes your acknowledgment that you have read, understood, and committed to these terms. If you do not agree to any of these terms, you must refrain from using the application or electronic portal.

By clicking "Agree", you acknowledge and agree to comply with all Terms and Conditions, including legal notices, Privacy Policy, disclaimer, and any additional terms or conditions displayed on the Jazem application or electronic portal from time to time.

Legal Notice: Jazem or any affiliated companies bear no legal responsibility for products or services provided through the platform. Clicking the "Agree" button constitutes a legal acknowledgment of your agreement and commitment to all of the above.

4. Account Activation Terms and Conditions on Jazem Platform

4.1 Username

The mobile phone number registered through the smart device used during the registration process is the approved "username" and is used to access Jazem platform services. The registration process must be completed from the same device to ensure user identity verification.

Username Change Controls:

  • If no consumer financing contract has been signed or "FLIP" gift card has not been used:
    A verification code (OTP) is sent to the new phone number, and once entered and confirmed to match, the username is automatically updated.
  • If the contract has been signed and/or financing or "FLIP" card has been used:
    Changing the username requires verification of national identity (ID card) and matching it with data registered with the company, in addition to biometric verification via facial image to ensure data matching.

4.2 Password

The password is the primary security means that grants you access to your personal account and is considered an electronic signature. If lost, you can request to reset it by contacting customer service center.

Password Requirements:

  • Must include at least one number.
  • Must contain at least one capital letter.
  • Must be no less than 8 characters.
  • Must include at least one special character (@, $, %, !).

Note:
You are fully responsible for password confidentiality and must notify us immediately if lost or suspected stolen to avoid any potential losses.

4.3 Information Accuracy and Liability Limitations

Despite Jazem's care for accuracy and updating of information displayed in the application and electronic portal, some errors or deficiencies may appear. The company reserves the right to modify or update any content without prior notice and rejects any requests that do not contain accurate or complete data.

4.4 Data and Content Submission by Users

All information and documents submitted by users - including questions, notes, reviews, or suggestions - become owned by Jazem without the right to claim their recovery.

Using misleading email, providing false information, or impersonating another party is prohibited. Jazem bears no responsibility for removing such content.

4.5 Data Supervision and Verification

Your authorization to use the application grants Jazem the right to collect, verify, and match your personal data (including financial, residential, and employment information) with official documents.

Verification may include matching national identity, address, and bank accounts, in addition to checking local and international anti-money laundering and sanctions lists (such as EU, UN, OFAC lists, etc.).

Failure to respond to verification requests may lead to service cancellation.

4.6 Legal Authorization and Company Powers

Your registration in the application is considered a written request granting Jazem the right to verify your credit record and information with official authorities. You also agree that the company may contact relevant third parties to implement verification and activation operations.

Jazem and the parent company reserve the full right to accept or reject providing service to any client according to their absolute discretion, without bearing any legal obligation in this regard.

The user acknowledges full and unconditional approval for the company to collect and retain all submitted documents and data and use them in accordance with relevant Saudi regulations.

5. Account Closure Mechanism by User

If you do not wish to continue using the Jazem application or electronic portal, you have the right to submit a request to close the account at any time, provided there are no outstanding financial obligations or installments. The following procedures are followed:

  1. Contact Jazem customer service to review and update personal data and verify account status.
  2. A service representative will deactivate the account from the system if conditions are met.
  3. If you wish to receive a final clearance letter, please disclose this when contacting the customer service representative.

6. Commercial Rights and Trademark Rights

  • According to Saudi Arabian regulations, particularly the Copyright Protection Law, Trademark Law, and Patent and Layout Designs Law, all rights related to the "Jazem" application and its services are reserved rights and fully owned by Jazem.
  • "Intellectual Property Rights" means, including but not limited to: patent rights, copyrights, trademarks, trade names, service marks, industrial designs, databases, know-how rights, and any other intellectual rights, whether registered or unregistered.
  • Jazem reserves all legal and intellectual rights related to the application, electronic portal, and all services, designs, materials, and technical content displayed on the platform.
  • No third party may use, reproduce, imitate or modify any part of trademarks, content, designs or technology of the application without obtaining prior written permission from Jazem.
  • Any violation of these rights is an explicit violation of regulations in force in the Kingdom of Saudi Arabia and grants the company the right to take necessary legal action.

7. Account Service Termination Rights

Jazem reserves its full right to terminate or suspend the user's account and terminate the validity of related Terms and Conditions at any time without needing to provide reasons, without incurring any legal obligation or liability toward the user, and without prior notice.

Upon account termination for any reason, your access to the application and electronic portal will be disabled, and all passwords assigned to you will be cancelled.

The user acknowledges and agrees that account termination does not exempt them from any financial or contractual obligations that arose before the termination date, including installment payments, financing obligations, or any due fees.

8. Warranty and Disclaimer

Jazem or its parent company makes no representations or warranties, express or implied, regarding the operation of the application or electronic portal, or the information, content, and materials available through them. The user acknowledges that they bear full legal responsibility for their use of the Jazem application or electronic portal.

Jazem does not guarantee that the application, electronic portal, its servers, or messages sent from them are free from viruses, malware, or harmful software.

9. Applicable Law

These terms are subject to the laws of the Kingdom of Saudi Arabia, and any dispute that may arise between the parties will be resolved according to these laws. Any dispute related to these terms will be resolved before the competent courts in the Kingdom of Saudi Arabia.

This agreement and all transactions conducted via Jazem platform are subject to regulations and legislation in force in the Kingdom of Saudi Arabia, including but not limited to:

  • Saudi E-Commerce Law issued by Royal Decree No. (M/126) dated 1440/11/07H.
  • Personal Data Protection Law issued by Royal Decree No. (M/19) dated 1443/2/9H.
  • Anti-Financial Fraud and Breach of Trust Law issued by Royal Decree No. (M/79) dated 1442/9/10H.

10. Force Majeure

You agree that Jazem will not be responsible for any delay or failure in providing its services if this results directly or indirectly from:

  • (a) Natural disasters such as fires, earthquakes, storms, floods, hurricanes, or severe weather conditions, or situations such as wars, terrorism, explosions, vandalism, or industrial strikes.
  • (b) Cyber attacks, communication interruptions, hardware failures, or third-party software failures.
  • (c) Sudden increase in demand for Jazem services exceeding normal levels, leading to software or hardware failure.
  • (d) Failure of any third party (including banks or financial institutions) to fulfill its obligations toward Jazem.
  • (e) Any other circumstances beyond Jazem's control.

11. Notices

Jazem may send notices via:

  • Publishing a general notice on the platform.
  • Email registered in your account.
  • Phone call or text messages to the number registered in your account.
  • Regular mail or prepaid mail to the address registered in your account.

Notice is considered received 48 hours after sending via regular mail or 12 hours after sending via email or phone.

12. Transfer of Rights and Obligations

Jazem may transfer or assign its rights and obligations under these terms to any other entity. You may not transfer or assign your rights or obligations under these terms without prior written approval from Jazem.

13. Amendments and Accessibility

Jazem has the right to modify these terms or platform policies at any time, and amendments will be published on the platform. Your continued use of the platform after publication of amendments constitutes acceptance of the new amendments. Jazem has the right to stop or modify any service or content on the platform without prior notice.

14. Severability

If any competent court determines that any provision of these terms is invalid or unenforceable, only that provision will be cancelled, and this will not affect the validity of the remaining terms.
